Ohm Outreach Marketing ("Company," "we," "us," or "our") provides AI voice agents, chatbots, and marketing automation services to local businesses ("Clients"). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website at ohmoutreachmarketing.com, use our services, or interact with our Clients' AI-powered communications on their behalf. This policy is designed to comply with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA/CPRA), and other applicable privacy laws.
This policy applies to two groups of people. First, our Clients, meaning the business owners and staff who purchase or use our services. Second, our Clients' customers and leads, meaning the individuals who call, text, or chat with the AI voice agents and chatbots we build and operate on behalf of our Clients ("End Users"). Where our practices differ between these groups, we explain the difference below.
From our Clients: When you sign up for our services we collect your name, email address, phone number, business name and details, billing information, and information about how you use our platform.
From End Users (our Clients' customers): When an End User interacts with an AI voice agent or chatbot we operate for a Client, we may collect the End User's name, phone number, email address, and any information they voluntarily share during the conversation, along with call recordings and chat transcripts of those interactions.
Automatically collected information: Like most websites, we use cookies and analytics tools to collect information such as IP address, browser and device type, pages viewed, referring website, and general usage patterns.
We use the information described above to deliver, operate, and improve our services; to build, train, and refine the AI voice agents and chatbots deployed for our Clients; to communicate with Clients about their accounts; to process payments; to provide customer support; to comply with legal obligations; and to send marketing communications where permitted (see Section 13).
Our services rely on artificial intelligence models, including large language models provided by OpenAI and Anthropic (Claude), to generate voice and chat responses. When an End User interacts with an AI agent, portions of that conversation are transmitted to these AI providers in real time so a response can be generated; this data is subject to the respective provider's own data handling terms in addition to our safeguards. We do not permit our AI providers to use Client or End User data to train their general-purpose foundation models outside of what is required to deliver the requested service, and we configure our integrations to limit data retention by these providers wherever such controls are available. We may use aggregated or de-identified conversation data internally to improve the accuracy and performance of the automation workflows we build, but we do not sell personal information to any AI provider.
Call recordings and chat transcripts are created and stored so our Clients can review interactions for quality assurance, training, dispute resolution, and service improvement. Recordings and transcripts are stored securely in our cloud infrastructure and are accessible only to authorized Company personnel and the relevant Client. Our Clients are responsible for ensuring that any legally required notice or consent for call recording (including applicable one-party or two-party consent laws) is provided to their own customers, and we provide tools to help Clients include such disclosures in their call flows. End Users may request access to or deletion of their recordings and transcripts as described in Section 8.
We use cookies, pixels, and similar tracking technologies on our website to remember preferences, understand how visitors use our site, and measure marketing performance. We use Google Analytics to collect aggregated usage statistics. You can control or disable cookies through your browser settings, though some site features may not function properly if cookies are disabled. Where required by law, we will request your consent before placing non-essential cookies.
We share personal information with trusted third-party service providers who help us deliver our services, including GoHighLevel (customer relationship management and marketing automation), Twilio (voice and SMS communications), OpenAI and Anthropic/Claude (AI language processing), Google Analytics (website analytics), a payment processor such as Stripe or PayPal (payment processing), and cloud hosting providers such as Amazon Web Services (AWS) or Google Cloud Platform (data storage). These providers are only given the information necessary to perform their functions and are contractually restricted from using it for any other purpose. We do not sell personal information. We may also disclose information if required by law, to protect our legal rights, or in connection with a business transaction such as a merger or acquisition.
Depending on where you live, you may have the right to access the personal information we hold about you, correct inaccurate information, request deletion of your information, request a copy of your information in a portable format, object to or restrict certain processing, and opt out of the sale or sharing of personal information (we do not sell personal information). California residents have rights under the CCPA/CPRA, and residents of the European Economic Area, UK, and Switzerland have rights under the GDPR. We retain personal information, call recordings, and chat transcripts for as long as necessary to provide our services, satisfy the purposes described in this policy, and comply with legal, accounting, or reporting obligations. Retention periods vary depending on the type of data and Client requirements; when data is no longer needed we securely delete or anonymize it.
We implement administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls and authentication requirements, regular security reviews, and restricted employee access on a need-to-know basis. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
In the event of a data breach affecting personal information, we will investigate promptly and notify affected individuals, Clients, and relevant regulators as required by applicable law and within the timeframes those laws specify. Notifications will describe the nature of the breach, the data involved, and steps being taken in response.
Our service providers and infrastructure may process and store data in the United States or other countries. Where we transfer personal information internationally, we rely on appropriate safeguards such as standard contractual clauses or equivalent legal mechanisms to ensure your information remains protected consistent with this policy and applicable law.
We may send marketing emails or text messages to Clients and, where a Client has authorized it, to End Users, in compliance with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and other applicable laws. You can opt out of marketing emails at any time using the unsubscribe link in any message, and you can opt out of marketing texts by replying STOP. Opting out of marketing communications does not affect transactional or service-related messages necessary to deliver our services.
Our services are intended for businesses and their adult customers. We do not knowingly target, market to, or collect personal information from children under the age of 16. If we learn that we have inadvertently collected information from a child, we will take steps to delete it promptly.
